Myanmar rebuts oral update of Special Rapporteur on the situation of Human Rights in Myanmar at 50th session of Human Rights Council

The Permanent Mission of the Republic of the Union of Myanmar to the United Nations Office in Geneva has objected to the oral update of the Special Rapporteur on the situation of human rights in Myanmar held on 29 June 2022 during the 50th session of the Human Rights Council in Geneva as it was totally based on one sided information and biased narrative, the Ministry of Foreign Affairs reported.

The rebuttal statement said it is disappointing to observe the presentation of the Special Rapporteur which does not reflect the suffering of nearly 3,000 innocent civilians who lost their lives due to killings and assassinations by the terrorists groups, such as the so-called CRPH, NUG and PDFs. Even though there was undeniable evidence of terrorists’ acts committed by the so-called PDFs, the Special Rapporteur intentionally fails to reflect these facts and evidences.

Furthermore, it is widely reported that the so-called NUG has the “hit list” for assassination of those who do not follow and support their agenda. Many local and international media reported about it. Though the Special Rapporteur includes unfounded allegations against the Government of Myanmar in his reports, he never mentions about the “hit list” while many innocent civilians were targeted and killed being accused of informants, the statement said.

As long as there are violent acts, terrorist attacks, killings, bombings perpetrated by the so-called NUG and their associates such as the so-called PDFs, the counter terrorism acts should be exercised in order to maintain the prevailing of the rule of law and peace and tranquility in the nation for the sake of the entire population. This is the utmost duty of the government of every nation in the world. There is no country in the world which accepts terrorist acts on its soil.

Individual sentences

The incumbent Government has every right to execute all powers and authorities vested by the State Constitution (2008) as an independent and sovereign state and all citizens in Myanmar receive fair and equal treatment of independent judicial system in Myanmar. The individual sentenced to death are those who were proved to be masterminds of orchestrating at least 50 assassinations against administrators and innocent civilians to instill fear and disrupt peace and stability. The Ministry of Foreign Affairs issued a press release on the matter on 6 June 2022, the statement pointed out.

Special Rapporteur’s visit to Malaysia

The Government of Myanmar has been addressing the underlying causes of today’s situation and maintaining law and public order. Some youths were victimized by the radical politicians who committed voter fraud and denied to settle the issue peacefully but incite the public to commit violence.

The Government of Myanmar therefore invites all those who wish to come back to their family and to enter legal fold. As of 23 June 2022, a total of 70 ex-members of so-called PDF returned legal fold and they were transferred to their parents. The invitation is attached herewith for reference.

Meanwhile it is shocked to learn the fuelling statement made by the Special Rapporteur after his recent visit to Malaysia. In addition to factitious allegations, the Special Rapporteur glorifies the terrorist organizations like NUG and PDFs and incites the international community to engage with them, the statement added. 

During his visit to Malaysia, he met anti-Myanmar government elements who provided unverifiable and one-sided information. It is time for the Special Rapporteur to stop making irresponsible remarks contrary to the code of conduct of the Special Procedure Mandate Holders, creating false hope to endanger the lives of Myanmar youths and generating divisions among the member states of the ASEAN.

Conference room paper

It is not clear that how many reports a Special Rapporteur can publish while Myanmar experiences unlimited reports were being issued by the Special Rapporteur on the situation of human rights in Myanmar under the name of conference room paper.

Myanmar further notes with serious concern that the Special Rapporteur organized an event on 28 June 2022 at Palais des Nations as it is not known which rules of procedure that the Special Rapporteur had applied in organizing such event and whether the Special Rapporteur can produce and set up unlimited reports and events.

The so-called conference room paper said 382 children were killed and it was verified by the UN but it does not mention how the UN has verified the number while the viewer would only see the narratives from the so-called AAPP. The AAPP list only includes names and ages without any verifiable data such as address, ID, parent’s name, place, date and time of incident. The so-called conference room paper only stated that individuals were killed “on the streets”, “in his village”, “in Loikaw Township”, “in Kalay Township” and some other townships without other details.

The so-called conference room paper of the Special Rapporteur ignores the 65 children including an 8-month old baby killed by the terrorists while this information are readily available. Furthermore, the stories and figures contained in the said paper are derived from narratives but not from actual facts and figures. There is neither real evidence of the numbers nor relevance, easily referring to a handful of sources without verification. While there is a total of 5.2 million students who have already enrolled at schools up to 31 May 2022, the Special Rapporteur’s reference of decrease in school enrollment is a clear disinformation, the statement said. 

Furthermore, it is noted that the Special Rapporteur worked with trusted unknown partners for the report which allowed the Special Rapporteur to invent his own narratives and made him a fabricator in the end.

The Special Rapporteur referred to several anti-government media outlets and organizations associated with armed groups which were never referred by other United Nations personnel.

Myanmar reopens universities and schools as its academic year starts in June after severe disturbance on children’s education by the COVID-19 pandemic. Regrettably, teachers and educational personal became target of the so-called PDF terrorists. Less than a month, 6 teachers were killed and 21 schools were attacked which made a total of over 43 death of education staff while 548 attacks against schools were committed by the so-called PDFs. It is well known that so-called NUG supporters publicly make life-threatening intimidations against children and parents for simply sending children to schools.

Instead the Special Rapporteur mandate is to promote the fundamental human rights, his call for international community to impose economic and financial sanctions on Myanmar and Unilateral Coercive Measures are contradict with the purposes and principles of the Charter of the United Nations and the International Law.

For the above reasons and his political motivated conclusions, the Government of Myanmar categorically rejects the Special Rapporteur’s oral presentation and urges the Special Rapporteur to uphold the principle of non-politicization and non-interference in internal affairs of a sovereign country, the statement said.
