UEC member: Investigation to NLD over abiding political parties’ registration law has not yet made

Member of Union Election Commission (UEC) U Khin Maung Oo said that investigation to NLD over abiding political parties’ registration has not been made and no prior decision has been made for abolishing NLD party.

He replied the query of a reporter on “is there any plan to abolish NLD party and if there is, when will they carry out the abolishing” at the news brief of State Administration Council’s Information Team  held at Ministry of Information on November 26.

“As our UEC has submitted earlier, we have so far investigated 38 political parties and investigation to NLD party has not been completed. The political parties have to abide by the political parties registration law, bylaw, national constitution, and existing laws. So, UEC has not made prior decision to abolish NLD party. We will do so in accordance with law and bylaw,” said U Khin Maung Oo.

Invitation has made to NLD party at the meeting of UEC and political parties but no contact was available and no one attended the meeting, he said.

National Politics Democratic party has sent a letter dated November 21,2021 in which it suggested for abolishing of NLD party. We received the letter and accepted its suggestion but there were no complete evidence. UEC is investigatig political parties and no investigation has been made to NLD party so far. We will do in accordance with the law, he continued.

UEC has sent letters to 93 political parties to examine whether political parties are abiding political parties registration law on May 24, 2021. The list of 93 political parties and central executive parties were sent to Ministry of Home Affairs. Political parties have signed to abide by the   political parties registration law section 6. In Chapter 3, 12 (a), (iii), it stated that a party shall not be entitled to subsist as a political party if it is involved with any of the following such as Contacting or abetting directly or indirectly an insurgent organization and individuals in revolt with arms against the State, organization and individuals designated by the State as committing terrorist acts or organization declared as unlawful association. And in section (iv ) having failed to abide by any admission contained in Section 6.

In 2008 Constitution, section 407, if a political party infringes one of the following stipulations, it shall have no right of continued existence; 

(a)    Having been declared an unlawful association under the existing law;

(b)    Directly or indirectly contacting or abetting the insurgent group launching armed rebellion against the Union or the associations and persons determined by the Union to have committed terrorist acts or the association declared to be an unlawful association;

(c) Directly or indirectly receiving and expending financial, material and other assistance from a foreign government, a religious association, other association or a person from a foreign country; 

(d) Abusing religion for political purpose.
