U Phyo Min Thein fined Ks100,000 under Section 130-A of Penal Code

U Phyo Min Thein has been fined 100,000 kyats under Section 130-A of the Penal Code for an offence related to exerting influence on the Union Election Commission (UEC) during the 2020 general election.

U Win Myint and Daw Aung San Suu Kyi have already been sentenced to three years in prison and labour under the same section of the law that only requires former Yangon Region Chief Minister U Phyo Min Thein to pay a fine of Ks100,000.

His sentence was passed by Dagon Township Court on February 17. 

Asked by The Daily Eleven about the fine, Major General Zaw Min Tun, spokesperson of the State Administration Council, said: “He violated the law and rules by not forming election sub-commissions at various levels in accord with the law and rules in the 2020 election. Therefore, Dagon Township Court fined him Ks100,000 under Section 130-A of the Penal Code. The sentence was passed on February 17 (Friday).

Under the same section of the law, former UEC chair U Hla Thein and ex-members U Than Htay and U Myint Naing were sentenced to three years in prison.

During a press conference held on July 1 last year, incumbent UEC member U Khyin Maung Oo said action had been taken against 2,173 people including the ex-UEC chair for failing to systematically supervise the electoral process in the 2020 general election. 

Moreover, ex-UEC chair U Hla Thein and 15 ex-members were also charged under Section 130-A and fined Ks100,000 each.

Of 1,417 election sub-commission chairs and members from the 2020 election, 2,173 had been given penalty in 373 cases, U Khin Maung Oo said.

He added that the court procedure was going on to take legal action against 489 people in 364 cases including the former President, the former State Counsellor, the former UEC chair and members, ex-minister U Min Thu, the former Nay Pyi Taw Council chairman, former region and state chief ministers, ex-members of parliaments, members of the committees for ensuring the party wins the election and ex-members of election sub-commissions.

U Phyo Min Thein testified in court as a plaintiff witness saying that he himself gave gold and US dollars to former State Counsellor Daw Aung San Suu Kyi charged under Section 55 of the Anti-Corruption Law.
