On October 22, a State Gazette was issued stating that a committee has been established to facilitate the signing of a Memorandum of Understanding (MoU) between Myanmar and China to establish a joint security company, led by the Deputy Minister for Home Affairs.
The committee, comprising 14 members, will be chaired by the Deputy Minister for Home Affairs, with the Chief of the Crime and Legal Affairs Department of the Myanmar Police Force serving as the secretary. Members of the committee include representatives from various ministries such as Transport and Communications, Defence, Planning and Finance, Foreign Affairs, Investment and Foreign Economic Relations, Legal Affairs, Immigration and Population, Labor, and Commerce.
The committee's responsibilities include reviewing whether the MoU aligns with the nation's sovereignty, benefits the public, adheres to national policies, and does not undermine defence and security interests. It will also assess compatibility with the Constitution, existing laws, and the potential need for additional considerations to address unforeseen circumstances.
Other evaluation points include potential impacts on political, economic, and social sectors, the inclusion of terms allowing for the company's dissolution upon the termination of the MoU, and regulations on the import and usage of weapons, specialized equipment, and security-related materials. The committee will also examine measures for addressing violations of existing laws, culture, and traditions by the proposed company, and determine whether adherence to security regulations issued by relevant ministries is appropriate. It is learned that it must also be reviewed whether the agreements to be entered into comply with the guidelines issued under Presidential Office Notification No. 41/2018 and other related provisions.
China proposed the establishment of the security company. The committee’s mandate will conclude upon the signing of the MoU, as outlined in an order issued by General Aung Lin Dwe, Secretary of the State Administration Council.
