Judge from Yangon Eastern District Court granted Ks20 million bail each for three detainees in related with Aung Yell Htwe death case on December 24.
Next court hearing will be held on January 7 and there are 11 defendant witnesses left to make testimony.
Yangon Region High Court ruled on December 13 that they changed the indictment to Section 325 of the Penal Code for Pyae Phyo Aung aka Aung Lay and Than Htut Aung aka Thar Gyi and Section 325/114 of the Penal Code for Kyaw Zaw Han aka Kyaw Zaw.
The indictment on them can apply bail and it shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to a fine.
Yangon Region District Court charged them under Section 302 (2) of the Penal Code for Pyae Phyo Aung aka Aung Lay and Than Htut Aung aka Thar Gyi and Section 302 (2)/ 114 of the Penal Code for Kyaw Zaw Han aka Kyaw Zaw on January 7.
The defendants were not satisfied with the charges on them and they made a formal complaint to Yangon Region High Court to change the charges on them. The high court accepted it and ruled it on December 13.
Famous social media comedian Aung Yell Htwe was fatally beaten by a group of men while he was attending a New Year’s Eve party at The ONE Entertainment Park in Thingangyun Township, Yangon. He died in hospital from head injuries on January 2.
His funeral was held at Yay Way cemetery on January 3 and the police arrested Pyae Phyo Aung aka Aung Lay, Than Htut Aung aka Thar Gyi and Kyaw Zaw Han aka Kyaw Zaw for a gang beating, according to Yangon Region police force.
Thuwunna police station opened a case against them under Section 302 of the Penal Code at Yangon Eastern District Court.
The trial was going on for about six months and the judge ruled to release the three suspects.
President Win Myint met with Union Chief Justice, Union Attorney General and Chairman of Anti-Corruption Commission at Presidential House on July 31 and instructed them to scrutinize about the background history of the withdrawal of Aung Yell Htwe’s case and took action in line with law.
The Anti-Corruption Commission investigated the case and found briberies in related with the case.
The Anti-Corruption Commission announced that former Yangon Region Attorney General Han Htoo received a bribe of Ks15 million, a bottle of Blue Label Scotch Whisky and a shirt; District law officer Ko Ko Lay Ks13 million and a bottle of Gold Label; District Deputy Law Officer Thit Thit Khin Ks3 million and a Batik; Deputy District Judge Aung Kyi Ks30 million, Police Inspector Chit Ko Ko Ks3 million; and Yangon Region Law Officer Thein Zaw Ks5 million.
They have been charged and they are facing lawsuits now.
