Myanmar court rules Daw Aung San Suu Kyi, three former ministers and Sean Turnell three years in prison each

Daw Aung San Suu Kyi, U Kyaw Win and U Soe Win, former ministers for planning and finance, former deputy minister U Sett Aung and Australian citizen Sean Turnell were ordered to serve three years in prison for the case in which they were prosecuted under the Myanmar Official Secrets Act, according to reports related with the case.

Former state counsellor Daw Aung San Suu Kyi, former planning and finance minister U Kyaw Win and former deputy minister U Sett Aung and Sean Turnell, who were charged under Section 3(1) (c) of the Myanmar Official Secrets Act on September 29 at the special court in Nay Pyi Taw Prison were brought to court from inside the prison and former planning and finance minister U Soe Win came to the trial from outside the prison.

In the above case, Sean Turnell was originally charged under Section 3(1) (c) of the Myanmar Official Secrets Act, and Daw Aung San Suu Kyi and the three former ministers were charged under Section 3(1) (c)/9 (encouraging and abetting) and sentenced to prison under these sections.

Section 3(1) of the Myanmar Official Secrets Act states that "Anyone who, with the intention of harming the national security or national interest" and section (c) states that " Obtains, collects, records or publishes or communicates to any other person, any secret official code or password, any sketch, plan, model, article, or note or other document or information which is calculated to be or is intended to be, directly or indirectly, useful to an enemy”, shall be punishable with imprisonment for a term which may extend, where the offence is committed in relation to any work of defense, arsenal, naval, military or air force establishment or station, mine, minefield, factory, dockyard, camp, ship or aircraft or otherwise in relation to the naval, military or air force affairs of the State or in relation to any secret official code, to fourteen years and in other cases to three years.

Currently, Daw Aung San Suu Kyi has been sentenced to a total of 23 years in prison for the cases that have been investigated and is being held separately in Nay Pyi Taw Prison.
