Shwe Mann's representative sues three including ex-minister, ex-MP

A representative of Thura Shwe Mann has opened a case against the former information minister Ye Htut, former Upper House MP Hla Swe and Bo Bo Kyaw Nyein under section 10 of the Law Protecting the Privacy and Security of Citizens at the Patta Police Station in Pobbathiri Township, Nay Pyi Taw, an on-duty officer from the police station told The Daily Eleven on July 2. 

The case was opened on April 30 and the three are under interrogation. 

When asked, the police officer said: "It is true that a case was opened against them. It is still under investigation. We cannot release details in respect for their dignity. A case was opened against the three person including U Hla Swe under section 10 of the Law Protecting the Privacy and Security of Citizens.”

"On the same day, Myo Min Latt, driver of U Shwe Mann, as a plaintiff, filed a case against them. He said their comments on Facebook broke personal freedom. They are U Ye Htut, U Hla Swe and U Bo Bo Kyaw Nyein," said the officer. 

Former MP Hla Swe said some officials came to his house for questioning. Only then did he know about the case, he added. 

"Four police officers from Pobbathiri Police Station came to my house. They told me they came as U Shwe Mann's driver opened a suit against us—U Ye Htut, U Bo Bo Kyaw and me. We face cases separately. They asked me if I made remarks when I received an interview with People's Voice Media. I replied yes," said Hla Swe. 

Hla Swe recounted that Thura Shwe Mann served three ranks in the army. Mocking Shwe Mann's political party establishment, Hla Swe said a shady tree can provide shelter for ten thousand birds. But the tree is grown in the wrong place. Grown next to an old building, the tree might be uprooted at the right time, he added. 

"When I appear in court I will have a chance to shoot questions," said Hla Swe. 

Former Information Minister Ye Hut said he didn't know about the case against him. 

"If I face a lawsuit, I will have a chance to question his actions in front of the court," said Ye Htut. 

Advocate Khin Zaw said U Shwe Mann did not know about the case against those three persons. 

"He himself does not know it. The lawsuit can filed only if he handed a general power," the lawyer said. 

As per section 10 of the Law Protecting the Privacy and Security of Citizens, whosoever is found guilty of committing an offence under Section 7 or Section 8, shall, in addition to a sentence for a period of at least six months, and up to three years, also be required to pay a fine of between three hundred thousand (300,000) and fifteen hundred thousand (1,500,000) kyats.
