Charges pressed against Dr Aye Maung and writer Wai Hin Aung

The Sittwe District Court decided to press charges against Dr Aye Maung and writer Wai Hin Aung under Section 122 (1) of high treason and Section 505 (b) of Penal Code (conducting public mischief) on September 10. 
 
The Section 17 (1) of the Unlawful Association Law against Dr Aye Maung and Writer Wai Hin Aung charged by police was cancelled. But, the court decided to press charges against Dr Aye Maung and writer Wai Hin Aung under Section 122 (1) and Section 505 (b) of Penal Code. The highest punishment may be up to death sentence. On September 14, the accused pair will be scrutinized in the trial.
 
“Dr Aye Maung is not only a politician but also a parliamentarian. He is the one who is attending peace conference. He is a representative to ethnic political parties, too. We are now going to Panglong. It is like going to federal. Dr Aye Maung talked on matters relating to federal at the literary talk. The politician is mentioning political words and expressions. It does not mean to cause political instability. Now charge under 122 (1) is high treason. 
 
“Actually the accused pair does not commit high treason. If the current government is not right, everyone commonly says the next government is coming. Dr Aye Maung is mentioning federal principle. For that reason, I would like to tell Dr Aye Maung does not violate Section 122 (1). This charge against Dr Aye Maung is wrong,” lawyer Kyaw Nyunt Maung of Dr Aye Maung.
 
In connection with the ruling, the trial was scheduled on September 14, said lawyer Kyaw Nyunt Maung.
 
“We will settle these two charges. The ceremony is the one that appeared since Thein Sein’s administration. I think a politician or a parliamentarian should have the right to say a little about something. In my positive view, I mean the government is civilian government, marching to federal democratic state. I think there is give and take in time of rebuilding the Union. The NLD government is more sensitive and more intense than Thein Sein’s administration.  Thein Sein’s administration is quite clever. We view the government changing into federal democracy first. He served much for the people. 
 
“He gave televised-speeches on current situations happening in the country to the people every month. He explained detailed current situations to the people. There are organizations capable of oppressing us. To the contrary, there are organizations capable of oppressing them. It is nature. The era the people live in fear want democracy. We must have reasoning power whatever we do or whatever we say. I remember Senior General Min Aung Hlaing said the big case should become the smaller one, and the smaller one should become nothing. I agree on it. In my view in my country, the big case has become the bigger one. 
 
“I mean exaggeration. Well, of course, how we approach national reconciliation? In Thein Sein’s administration, all chief ministers of States and Regions were retired ministers and they managed to administer. The words what I mentioned are different from those to Chief Minister Nyi Pu and State Counsellor Aung San Suu Kyi. The words are different in voice recording. We will have to clarify the charge again. One thing I worry is if the charges are pressed against the cases submitted to the president. If so, the people will become suspicious of independent jurisdiction. I would like the case to be fair. The 122 means a war with State. We don’t have even one toothpick. I think a politician or a parliamentarian should have the right to talk a little something like that. Now looks stricter than Thein Sein’s administration,” said Dr Aye Maung.
 
“According to the 1973, there must be only a single charge. Now is even two charges,” said writer Wai Hin Aung.
Police have filed charges under the Section 17 (1) of the Unlawful Association Law against Dr. Aye Maung and writer Wai Hin Aung, who gave a talk to mark the 233rd anniversary of the fall of the Rakhine Kingdom in Yathedaung Monday.
 
The talk was organised by the May Yu Yin Thwe social service society at the Cedi Yingana Monastery in Taungyintan Ward in Yathedaung Township from 1 pm to 3:15 pm.
 
Speaking on the occasion, author Wai Hin Aung, also known as Aung Kyaw Win said, “Rakhine State has lost its sovereignty for 233 years, it means about five generations were away from sovereignty. Today, the AA (Arakan Army) armed group led by Tun Myat Naing are undertaking an armed struggle for regaining Rakhine State and Rakhine’s sovereignty and to free them from servitude by Burma. All the people in Yathedaung Township have a duty for freedom from the servitude by Burmese. Today is the time when the government is in political crisis, and this situation brings good advantage to us. Also, it is the right time for us to take armed struggle to gain our independence. All must participate in this struggle.” Speaking at the same event, Dr. Aye Maung said, “Burmese people consider Rakhine people as slaves and do not give equal rights to us. There are only two ways to regain our sovereignty. Some are taking armed struggle.”
 
Dr. Aye Maung urged the people to take advantage of the weakness of the government and to march towards the goal of sovereignty. He said the movement for liberty is being done by organising the people and undertaking armed struggle towards the goal.
 
This kind of talk is aimed at alerting the people to know the goal of the Rakhine people, and they are obliged to participate in it, said Dr. Aye Maung.
 
 The talk by Dr. Aye Maung and author Wai Hin Aung, also known as Aung Kyaw Win, was discussed at the Rakhine State Government’s cabinet meeting held on 16 January, at which they decided to open a file in accordance with the law against the men and others who were involved in organising the talk, authorities said.
 
The charges were filed at the Yathedaung Police Station against Dr. Aye Maung and Wai Hin Aung under Section 17 (1) of the Unlawful Association Law, Section 505 of public mischief (b) and Section 122 (1) of high treason. 
 
 Wai Hin Aung has been detained at the Sittway Township Police Station, according to the Myanmar Police Force.
